§4. Technical Requirements
- Using the Shop requires:
- a device with Internet access,
- an up-to-date web browser,
- an active e-mail address,
- the ability to use a payment method available in the Shop.
- Using the Shop does not require creating a user account, unless stated otherwise for a given Shop feature.
- The Client must use the Shop in a manner consistent with the law and good practice.
§5. Offer and Prices
- Prices in the Shop are given in Polish zloty (PLN) and are gross prices.
- Before placing an Order, the Client is informed of the total price of the Service or Product ordered, including the price of selected Additional Services and any other costs, if applicable.
- The price shown at the time the Order is placed is binding on the Client.
- The scope of each Service, the number of photos, session length, scope of editing, method of delivering materials and other elements of the service are set out in the description of the given offer in the Shop.
- The duration stated for a photo session may refer to the photographic part only. Selecting an Additional Service, in particular make-up where the offer includes it, may extend the total time needed to complete the Order.
§6. Placing and Paying for an Order
- Orders can be placed in the Shop 24 hours a day.
- To order a Service, the Client:
- selects the appropriate Service or package,
- selects any Additional Services, where the offer includes them,
- selects an available date, if the Service requires a Booking,
- provides the data required to fulfil the Order,
- accepts these Terms,
- confirms having read the Privacy Policy,
- makes the payment.
- All Orders placed via the Shop must be paid in full in advance.
- A paid Order is placed using the “Proceed to payment →” button or another button clearly indicating that placing the Order entails an obligation to pay.
- Payment for an Order can be made:
- using the electronic payment methods available in the Shop and handled by Stripe (in particular payment card, BLIK or Przelewy24 — the methods currently available are shown on the payment page),
- by bank transfer to the Seller’s account held with mBank S.A., if this method is available for the given Order.
- Card payments made outside the Shop, in particular payments made on site using a payment terminal, are not a payment method for Orders placed via the Shop, unless the Seller expressly agrees otherwise with the Client.
- A Booking becomes effective once the full amount due for the Order has been settled, including — where the offer provides for it — by applying a Voucher or other means of settlement covering the full amount due.
- Failure to settle the full amount due means that the Booking is not final. A date selected in the booking system is temporarily held while the payment is made; if the payment is not made, the date is released.
- After successfully placing and paying for an Order, the Client receives a confirmation at the e-mail address provided.
§7. Booking a Date
- For Services performed on a specific date, the Client selects one of the dates available in the Shop’s booking system.
- The selected date becomes part of the Order.
- A Booking is effective once the conditions set out in §6 are met.
- The time stated in the Booking is the time at which the Client should arrive at the place where the Service is performed.
- Where the offer includes make-up as an Additional Service and it has been selected for the photo session, the Client arrives at the time stated in the Booking.
- A Client having make-up is not required to arrive before the time stated in the Booking.
- Make-up takes place after the Booking start time and extends the Client’s total time on site and the time needed to complete the Order accordingly.
- A technical extension by the Seller of the Booking time in the system or calendar due to a selected Additional Service does not change the Service start time communicated to the Client.
- The session time stated for a given package need not correspond to the Client’s total time on site if the Order includes Additional Services.
§8. Punctuality and Performance of the Service
- The Client should arrive on time at the place where the Service is performed.
- The Client’s late arrival does not automatically postpone subsequent Bookings or extend the time allotted for the Service.
- If, due to the Client’s late arrival, full performance of the Service within the scheduled time would be impossible without affecting subsequent Bookings, the Service time may be shortened accordingly.
- If performing the Service on the agreed date becomes impossible for reasons attributable to the Seller, the Seller will offer the Client a new date or refund the amount paid.
- A change of date for reasons attributable to the Seller may not result in any additional costs for the Client.
§9. Rescheduling, Cancellation and No-Shows
- The Client may ask the Seller to reschedule or cancel a Booking.
- This section sets out the rules for voluntary rescheduling or cancellation of a Booking and does not limit the Consumer’s statutory right to withdraw from the Contract described in §11.
- After the statutory withdrawal period has expired, or where the right of withdrawal does not apply or has expired, the following rules apply:
- if cancelled more than 72 hours before the Service start time, the Client may choose another available date or receive a refund of the amount paid;
- if cancelled between 24 and 72 hours before the Service start time, the Client is entitled to a refund of 50% of the amount paid;
- if cancelled less than 24 hours before the Service start time, the amount paid is non-refundable.
- Failure to attend the Service without prior cancellation of the Booking is treated as a cancellation made less than 24 hours before the Service start time.
- With the Seller’s consent, the Client may move the Booking to another available date instead of receiving a refund.
- Refunds are, as a rule, made using the same payment method used by the Client, unless the Client expressly agrees to another refund method that involves no cost to them.
§10. Completion and Delivery of Materials
- The scope of materials delivered to the Client, the method of delivery and the expected completion time are set out in the description of the Service ordered.
- If the Service includes the Client selecting photos, further performance of the Service may depend on that selection being made.
- Completion times that depend on the Client’s action, in particular retouching times after the selection of photos, run from the day the Client performs the required action.
- The Seller archives the final photographic material covered by the Order for three months from the date it is delivered to the Client.
- After the archiving period, the Seller does not guarantee that the materials can be made available again.
§11. Consumer’s Right to Withdraw from the Contract
- A Consumer who has concluded a distance Contract has, as a rule, the right to withdraw from it without giving any reason within 14 days of the date the Contract was concluded, subject to the exceptions provided for by applicable law.
- To meet the deadline, it is sufficient to send the withdrawal statement before the deadline expires.
- The withdrawal statement may be sent in particular by e-mail to foto@fantasmatic.pl.
- The Consumer may use the statutory model withdrawal form, but this is not mandatory.
- If the Consumer wants performance of the Service to begin before the 14-day withdrawal period expires, they make an express request during the Order process to begin performance of the Service on the selected date.
- For this purpose, the booking form requires the Consumer to tick a separate box with the following wording:
“I request that performance of the ordered service begin on the selected date, even if that date falls within 14 days of concluding the contract. I acknowledge that once the service has been fully performed, I will lose the right to withdraw from the contract.”
- The Consumer acknowledges that once the Service has been fully performed, having been started with their express consent and after they were informed of the loss of the right of withdrawal upon full performance, the right to withdraw from the Contract expires in accordance with applicable law.
- If, at the Consumer’s express request, performance of the Service began before the withdrawal period expired, but the Consumer effectively withdraws from the Contract before the Service has been fully performed, they must pay for the services provided up to the moment of withdrawal to the extent provided for by applicable law.
- The provisions on voluntary cancellation of a Booking do not limit the Consumer’s rights under mandatory provisions of law.
- In the event of an effective withdrawal from the Contract, the Seller refunds the payments due to the Consumer within the period provided for by law, as a rule using the same payment method used by the Consumer, unless the Consumer expressly agrees to another refund method that involves no cost to them.
§12. Vouchers
- Where the Shop’s offer includes the sale of Vouchers, the Seller allows the purchase of:
- Vouchers entitling the holder to a specific Service stated on the Voucher,
- Vouchers of a specified monetary value that can be spent on Services offered by the Seller.
- A Voucher is valid for 12 months from the date of purchase, unless a different start date of its validity period is expressly stated on the Voucher.
- After the validity period, the Voucher expires.
- The validity period of a Voucher cannot be extended.
- A Voucher is personalised.
- A Voucher may only be used by the person named on it.
- A Voucher may not be transferred, resold or passed on to another person for use.
- For a Voucher issued for a specific Service, a later change in the price of that Service does not affect the possibility of redeeming it.
- The entitled person may redeem the Service stated on the Voucher without having to pay any surcharge resulting solely from an increase in the price of that Service after the Voucher was purchased.
- For a value Voucher, the Service prices applicable on the day the Booking is made apply when it is redeemed.
- If the price of the selected Service exceeds the value of the value Voucher, the person redeeming it must pay the difference.
- If the price of the selected Service is lower than the value of the value Voucher, the unused part of the Voucher value is not paid out in cash or refunded.
- With the Seller’s consent, the unused part of the Voucher value may be used for additional Services or other benefits offered by the Seller in connection with redeeming the Voucher.
- A date for a Service covered by a Voucher can be booked:
- by phone,
- by e-mail,
- using the Shop’s booking system, if it allows the unique Voucher code to be entered.
- Holding a Voucher does not in itself constitute a Booking of a specific date.
- The availability of dates depends on current availability in the Seller’s calendar.
- A Booking using a Voucher must be made effectively within the Voucher’s validity period.
- The Service may take place after the Voucher’s validity period, provided the Booking was effectively made before it expired.
- Vouchers are normally delivered electronically to the e-mail address provided at purchase.
- At the Buyer’s individual request, a Voucher may also be prepared in printed form.
- If preparing or delivering a printed Voucher involves an additional cost, the Buyer will be informed of it before it is incurred.
- A Voucher cannot be exchanged for cash, without prejudice to the Consumer’s statutory right of withdrawal and other rights under mandatory provisions of law.
- A Consumer who purchased a Voucher at a distance may withdraw from the purchase Contract within 14 days under the rules set out in §11, subject to the exceptions provided for by applicable law.
- Upon effective withdrawal from the Voucher purchase Contract, the Voucher is cancelled and cannot be used.
- If, before the withdrawal period expires, the Voucher was used for a Booking and performance of the Service began at the Consumer’s express request, the relevant rules set out in §11 apply.
§13. Complaints
- The Seller must perform the Contract in accordance with its terms and applicable law.
- The Client may submit a complaint in particular:
- by e-mail to foto@fantasmatic.pl,
- in writing to the Seller’s address.
- A complaint should, where possible, include:
- the Client’s details,
- information identifying the Order,
- a description of the issue,
- the Client’s request.
- If the complaint concerns specific photographs, indicating file numbers or names may help resolve it, but failure to do so does not deprive the Consumer of the right to file a complaint.
- The Seller responds to a Consumer’s complaint within 14 days of receiving it, unless mandatory provisions of law provide for a different period.
- Failure to file a complaint within a period specified by the Seller does not result in the loss of the Consumer’s statutory rights.
- The provisions of these Terms do not limit the Client’s rights under mandatory provisions of law.
§14. Personal Data
- The controller of Clients’ personal data is FANTASMATIC SP. Z O.O..
- Clients’ personal data is processed in particular for the purposes of:
- concluding and performing the Contract,
- handling Bookings,
- handling payments,
- issuing accounting documents,
- handling complaints,
- fulfilling the Seller’s legal obligations.
- Detailed information on the processing of personal data, the legal bases for processing, retention periods, recipients of data and the rights of data subjects is set out in the Privacy Policy available in the Shop.
- Providing the data required to fulfil an Order is voluntary, but failure to provide it may prevent the Contract from being concluded or performed.
- Accepting these Terms does not constitute consent to all forms of personal data processing. Personal data is processed on the appropriate legal bases set out in the Privacy Policy.
§15. Out-of-Court Dispute Resolution
- A Consumer may use out-of-court methods of handling complaints and pursuing claims under the rules set out in applicable law.
- Information on available out-of-court methods of resolving consumer disputes can be obtained in particular:
- on the website of the Polish Office of Competition and Consumer Protection (UOKiK),
- from municipal and district consumer ombudsmen,
- from other institutions authorised to conduct out-of-court consumer dispute resolution proceedings.
- Information on out-of-court consumer dispute resolution and on ADR bodies operating in European Union member states is also available on the European Commission’s “Consumer Redress in the EU” website.
§16. Final Provisions
- Contracts concluded via the Shop are concluded in Polish.
- These Terms are available free of charge in the Shop at fantasmatic.eu/en/terms (Polish version: fantasmatic.eu/regulamin) in a form that allows them to be saved and reproduced.
- Matters not governed by these Terms are subject to applicable Polish law, in particular the Civil Code and the Consumer Rights Act.
- No provision of these Terms excludes or limits the Consumer’s rights under mandatory provisions of law.
- If any provision of these Terms proves invalid or ineffective, this does not affect the validity of the remaining provisions.
- The Seller may amend these Terms for valid reasons, in particular in the event of:
- changes in the law,
- changes in how the Shop operates,
- changes in payment methods,
- changes in how Bookings are made,
- changes in the scope or manner of performing the Services.
- An amendment to these Terms does not affect rights acquired by Clients or Orders concluded before the amended Terms came into force.
- These Terms apply from 19 October 2026.
